These Terms govern your access to and use of the websites and services operated by Trinity Meds, Inc. d.b.a. Trinity Meds, connecting users to the telehealth platform operated by OpenLoop Health, Inc.
THESE TERMS CONTAIN A BINDING ARBITRATION AGREEMENT AND CLASS ACTION WAIVER. ALL DISPUTES WILL BE RESOLVED BY BINDING, INDIVIDUAL ARBITRATION.
Acceptance of Terms
By accessing or using the Website or Services, you agree to be bound by these Terms as a legally binding agreement.
Amendment of Terms
We may amend these Terms from time to time. Your continued use after posting of amended Terms constitutes acceptance.
Eligibility
You must be at least 18 years of age to access or use the Website or Services.
Your Relationship with Us
Trinity Meds does not provide medical advice, diagnosis, or treatment. All healthcare services are provided exclusively by the Professional Entities and their licensed healthcare professionals.
Financial Responsibility
Neither Trinity Meds nor OpenLoop participate in Medicare, Medicaid, or any private payor program. By using the Services, you elect cash-pay care and are solely financially responsible.
Telehealth Consent
To use the Services you must consent to treatment via telehealth. Please see the Telehealth Consent.
Content License
All Content is protected by intellectual property laws. Trinity Meds grants a limited, non-exclusive, non-transferable license for personal, non-commercial use only.
Prescriptions & Subscriptions
Prescription products require a valid prescription. Subscriptions auto-renew and can be cancelled up to 48 hours before the monthly processing date by emailing care@trinitymeds.com.
Accuracy & Security
You are responsible for your use of the Services. All information provided must be current, accurate, complete, and truthful.
Prohibited Conduct
Prohibited conduct includes: harassment, fraud, reverse engineering, scraping, uploading malicious content, spam, and any unlawful use of the Website.
Refunds
All sales are final except as stated in the Refund & Cancellation Policy or as required by law.
Termination
We reserve the right to terminate or suspend your access at any time, with or without notice, for any reason including violations of these Terms.
Data Retention
Trinity Meds retains personal information only as long as reasonably necessary to provide services, comply with legal obligations, resolve disputes, and enforce agreements.
Indemnification
You agree to defend and hold harmless Trinity Meds, OpenLoop, their affiliates, officers, directors, and employees from any claims arising from your use of the Services.
Disclaimer of Warranties
The Services are provided on an 'as is' basis. Trinity Meds disclaims all warranties, express or implied, to the maximum extent permitted by law.
Limitation of Liability
Trinity Meds's aggregate liability shall not exceed the greater of: total amounts paid in the prior 12 months, or USD $100.
Arbitration Opt-Out
You may opt out of this Arbitration Agreement within 30 days of first purchase by sending written notice to Trinity Meds, Inc., 3206 NE 2nd Ave, Suite 3013, Miami, FL 33137.
Governing Law
These Terms shall be governed by the laws of the State of Florida. Disputes in court shall be brought in Miami-Dade County, Florida.
